Your rights and responsibilities as a resident

Charter of Residents Rights and Responsibilities

These are outlined in the Charter of Residents’ Rights and Responsibilities and are included in legislation to ensure their protection. You can read the charter on the Department of Health and Ageing website.

The resident agreement

After accepting a place in an aged care home and completing Part B of your application, the manager must offer you a resident agreement (more information). This is a legal document that sets out the terms of your residency in the home, and the rights and responsibilities of both you and the home.

Can I participate in the way the home is run?

As a resident, you (or your carer, friend or family) have the right to participate in decisions about the services that you receive. If you’d like to be involved, ask your aged care home how they make sure that you can have your say on the running of the home. The options might include regular ‘resident meetings’ at which all residents can express their views, or an appointment with a staff member to discuss your own care and choices.
