Common question

Question: What happens if I move from one low-level (hostel) care to another low-level aged care home?
Answer: Special arrangements apply if you move to another aged care home (‘second home’) within 28 days of leaving a previous home (‘first home’), including: if you paid an accommodation bond to the first home, then the maximum amount of accommodation bond which you can be charged in the second home is the accommodation bond balance from the first home. If you paid an entry contribution under the General Conditions formulated under section 10F of the Aged or Disabled Person Care Act 1954 and move from one service to another service, similar rules apply. In this case, the maximum amount of bond payable to the second home is the amount of entry contribution refunded by the first home. If the accommodation bond in the first home was paid wholly by periodic payments, the maximum amount of accommodation bond payable to the second home on transfer is the lump sum equivalent less retention amounts for the number of months for which retentions were payable to the first home. The accommodation bond balance is the amount of the lump sum payment of an accommodation bond that remains after deducting from it: retention amounts; amounts owed to the service provider under an accommodation bond agreement, extra service agreement or resident agreement; and interest on amounts owed to the service provider under an accommodation bond agreement, extra service agreement or resident agreement (e.g. interest on overdue fees, or overdue periodic payments). No other amounts may be deducted from accommodation bonds.
