Question: One of the reasons Mum and Dad chose the retirement village they are in was that there is also a nice residential aged care home there. Now Dad needs to move to residential care, but the home says they can't take him as they have no vacancies. Can they do this?
Answer: Many retirement villages include or are adjacent to a residential aged care home. However, the retirement village is regulated by state legislation and the residential aged care home is subsidised and regulated by Commonwealth legislation. Even if there is a residential aged care home on the site, there is no guarantee that residents of the village will get a place there when they need one. The residential care home will only have a fixed number of places. Once the places are filled they cannot force someone out to admit a village resident. The ACAT will be able to tell you of other homes in the area.
