Notices of Non-Compliance

Notices of non-compliance may be issued by the Department of Health and Ageing (the Department) where an approved provider is not complying with its responsibilities in providing required care and services. The notice of non-compliance issued to the approved provider identifies the problems that need to be addressed and by when. The approved provider is encouraged to meet with care recipients, tell them about the identified problems and explain what it will be doing to fix them.

Information is published about notices of non-compliance on the Department’s website and includes the names and addresses of services, the names of the relevant approved providers, the actions taken by the Department under the Aged Care Act 1997, the reasons for those actions, relevant dates and the status of the services. Links are provided below.

If the non-compliance is not remedied, sanctions may ultimately be imposed on the approved provider. Where there is an immediate and severe risk to the health, safety or wellbeing of care recipients the Department may impose sanctions without issuing a notice of non-compliance.
